These Terms and Conditions (“Terms”) govern your access to and use of the Blush On The Daley website, online booking pages, forms, digital resources, communications, and services provided by Blush On The Daley, LLC (“BOTD,” “we,” “us,” or “our”). By using the website, submitting a form, booking an appointment, purchasing a product or service, enrolling in a membership, or participating in a BOTD program, you agree to these Terms and any service-specific terms presented to you at checkout or before your appointment.

If you do not agree to these Terms, do not use the website, submit information, book an appointment, or purchase a BOTD service.

1. Business Information and Contact

Blush On The Daley, LLC is a nurse-led permanent makeup and aesthetic studio operated under the public brand Blush On The Daley (BOTD).

BOTD may update its contact information, service locations, operating hours, booking links, or communication channels from time to time. The current information displayed on the website or in your booking confirmation controls for the applicable interaction.

2. Scope of These Terms

These Terms apply to:

• Website browsing and content;
• consultations and appointments;
• permanent makeup, restorative PMU, tattoo-removal, facial, lash, and beauty services;
• memberships and loyalty benefits;
• academy courses, model sessions, and educational resources;
• digital products and other items offered through BOTD;
• booth-rental or independent-contractor arrangements, where separately accepted in writing; and
• email, SMS, booking, customer-support, and automated communications.

These Terms do not replace an informed-consent form, medical history form, treatment consent, aftercare instructions, membership enrollment agreement, course agreement, independent-contractor agreement, or any other document that you are asked to review and sign. If a specific signed agreement conflicts with these Terms, the specific signed agreement controls for that subject to the extent permitted by law.

3. Eligibility and Age Requirement

All BOTD services are for individuals 18 years of age or older unless BOTD has a written policy that expressly permits otherwise and all legally required consent is obtained. BOTD may request government-issued identification before providing a service.

You represent that the information you provide is accurate, complete, and current. You must promptly tell BOTD if your contact information, health information relevant to the service, medications, allergies, or other eligibility information changes.

4. Website Use

You may use this website only for lawful purposes and in accordance with these Terms. You agree not to:

• use the website to violate any law or regulation;
• submit false, misleading, fraudulent, or unauthorized information;
• interfere with the website, booking system, forms, payment systems, or security features;
• attempt to access another person’s account or private information;
• copy, scrape, reproduce, resell, or exploit website content without written permission;
• upload malicious code, spam, or harmful material; or
• use the website or BOTD communications to harass, threaten, impersonate, or abuse BOTD personnel or other clients.

BOTD may suspend or restrict website access, cancel a booking, or refuse service when reasonably necessary to protect clients, staff, the business, the website, or the integrity of the booking and payment systems.

5. Services and Results

BOTD offers nurse-led permanent makeup and aesthetic services, which may include Luxé Nano Brows, Ombré Brows, Combo Brows, Cover-Up/Correction, Brow Perfecting Sessions, Restorative Brow™, color maintenance, beauty marks or faux freckles, brow sculpting, facials, lash services, PMU tattoo removal, educational services, and related products or add-ons.

Descriptions, photographs, testimonials, time estimates, pricing, and results shown on the website are for general information. Results vary based on skin type, age, health, medications, lifestyle, aftercare, pigment retention, existing permanent makeup, healing response, and other factors outside BOTD’s control. Before-and-after images are examples of individual client outcomes and are not a guarantee of a particular result.

BOTD may determine that a requested service is not appropriate, safe, or suitable for you. BOTD may modify, postpone, refuse, or discontinue a service when the artist or clinician determines that doing so is reasonably necessary for safety, eligibility, healing, or the quality of the work.

6. Consultations and Eligibility Review

A consultation may be recommended or required before a service. The current price list identifies the Luxé Consultation Experience as a paid consultation, with the stated credit applied toward a booked service according to the applicable booking terms.

A consultation does not guarantee that BOTD will provide a procedure, approve a requested design, accept a booking, or determine that you are eligible for a service. BOTD may request additional information, a patch test, physician clearance, a doctor’s note, or a Letter of Medical Necessity before confirming or performing a service.

BOTD services are not emergency care and the website, AI assistant, email, SMS, and customer-support channels are not monitored as emergency medical services. If you have an emergency, contact 911 or your local emergency service.

7. Health Information, Disclosure, and Client Responsibility

Before a procedure or other service, you must accurately disclose health conditions, allergies, medications, supplements, recent procedures, skin conditions, pregnancy-related information, blood-thinning medication, sensitivities, prior permanent makeup, and any other information requested in BOTD’s intake or consent forms.

You are responsible for following all pre-care and aftercare instructions, attending recommended follow-up appointments, monitoring your healing, and contacting an appropriate healthcare professional when you have a medical concern. BOTD may provide general aftercare information, but it does not replace individualized medical advice from your treating clinician.

Do not send sensitive medical information through ordinary SMS. Use the secure form or upload method provided by BOTD when requested.

8. Restorative Brow™ Requirements

BOTD Restorative Brow™ is a paramedical permanent makeup package intended for eyebrow restoration following a medical circumstance. A physician clearance or doctor’s note is required for all Restorative Brow™ clients without exception and must be submitted before the appointment is confirmed.

The Restorative Brow™ package is a one-time $1,299 package that includes:

• the initial Brow Session;
• the Brow Perfecting Session, which is the second and final session normally scheduled 8–12 weeks after the initial session; and
• the complimentary consultation described in the current offer or price list.

The included second session is not a separate $499 charge. BOTD may keep a requested appointment in a pending status until the required clearance and booking-payment conditions are satisfied. HSA/FSA eligibility is determined by the client’s plan administrator. BOTD does not guarantee reimbursement or eligibility; any Letter of Medical Necessity must be obtained from the client’s treating physician.

9. Standard Brow Service Structure

Ombré Brows, Luxé Nano Brows, Combo Brows, and Cover-Up/Correction follow a two-visit process. The initial session and the Brow Perfecting Session are billed separately.

The Brow Perfecting Session is the second and final session, normally scheduled 8–12 weeks after the initial session, and is a separate one-time service currently listed at $499. Booking the initial standard brow service does not include the Brow Perfecting Session unless a written BOTD package specifically states otherwise.

Cover-Up/Correction requires a full assessment because existing permanent makeup, pigment saturation, color, scar tissue, skin condition, or prior procedures may affect eligibility, technique, price, timing, and expected results.

10. Booking, Appointment Confirmation, and Scheduling

An online booking request is not necessarily a confirmed appointment until BOTD’s booking system or team provides a confirmation. BOTD may contact you to verify information, collect a retainer, request forms or clearance, or confirm the correct service before final confirmation.

Appointment times are subject to availability. BOTD may adjust or reschedule an appointment because of staffing, illness, safety, equipment, facility, weather, or other operational reasons. If BOTD must reschedule, BOTD will make reasonable efforts to notify you and offer available alternatives.

You are responsible for arriving on time, completing required forms before the appointment, bringing requested documentation, and allowing enough time for the full service. Late arrival may shorten, require rescheduling, or prevent completion of the service.

11. Retainers, Cancellation, Late Cancellation, and No-Show Policy

The current BOTD price list states that a 25% non-refundable retainer is required at booking. The retainer is a payment toward the applicable service or package; it is not a second service charge. Unless required otherwise by law or expressly approved in writing by BOTD, the retainer is not refundable.

The current BOTD price list also states:

• at least 72 hours’ notice is required to cancel or reschedule an appointment;
• a $50 late-cancellation fee may apply when the required notice is not provided; and
• a $200 no-show fee may apply when a client does not attend and has not timely canceled or rescheduled.

These charges may be collected using the payment method authorized for the booking, where permitted. A client who repeatedly cancels late, does not attend, or fails to complete required forms may be required to prepay, provide a larger deposit, or obtain staff approval before booking again.

If BOTD publishes a more specific cancellation rule in a booking confirmation, checkout page, signed agreement, or service-specific policy, that more specific rule controls for the appointment. BOTD may waive or modify a fee only in writing.

12. Pricing, Payments, and Balances

Prices are shown in U.S. dollars and may change. The price displayed at the time of purchase or booking, together with the applicable confirmation, controls unless a written error correction is required.

BOTD may accept payment methods displayed on the website or current price list, which may include cash, card, Zelle, Afterpay, Klarna, Affirm, and certain cryptocurrency or other payment methods. A payment provider may impose its own terms, eligibility requirements, fees, financing terms, or privacy practices.

A retainer does not necessarily satisfy the full balance. Unless the booking confirmation states otherwise, the remaining balance is due according to BOTD’s payment instructions before or at the appointment. You authorize BOTD and its payment providers to process authorized charges, retainers, balances, membership charges, and applicable cancellation or no-show fees.

BOTD is not responsible for a payment provider’s approval decision, financing terms, service interruption, exchange rate, wallet error, chargeback decision, or separate provider policy. You are responsible for reviewing the provider’s terms before using that payment method.

13. Refunds, Credits, Corrections, and Service Concerns

Retainers are non-refundable as stated above. Because BOTD services are customized, time-reserved, and performed for an individual client, completed services are generally not refundable based solely on a change of mind, a subjective preference, or a result that differs from an example image.

If you have a concern about a service, contact BOTD promptly so the team can review the concern and determine whether a reasonable adjustment, aftercare recommendation, or other resolution is appropriate. Any correction or additional work is subject to eligibility, healing status, scheduling, and BOTD’s written approval; it is not automatically free.

Product, digital-resource, course, model-session, package, membership, and event refunds or credits may be governed by additional terms shown at checkout. Nothing in these Terms limits a non-waivable refund, cancellation, or consumer right under applicable law.

14. Lash Society Memberships

The Lash Society memberships are the only BOTD services intended to create recurring payments. The current plans are:

• Basic Lash Society: $159 per month;
• Premium Lash Society: $219 per month.

Memberships are month-to-month and require a card on file. Benefits do not roll over. The initial lash set is paid separately and is not included merely because a client enrolls in a membership.

Current benefits may include refill allowances, discounts, priority booking, points multipliers, and stated annual benefits. The benefits, limits, annual renewal timing, eligible services, and exclusions are those shown at enrollment or in the then-current membership description. BOTD may require staff verification of available benefits before confirming a refill or complimentary service.

Membership charges continue until the membership is canceled or otherwise ended under the applicable membership terms. To avoid the next charge, request cancellation before the next billing date through the channel identified by BOTD or the membership checkout. A charge already processed may not be refundable except as required by law or stated in the membership terms. Failed payments may cause benefits to be paused or the membership to be placed into a past-due status until payment is updated.

BOTD will not convert a one-time service into a subscription without the client’s affirmative enrollment in a recurring membership.

15. Tattoo Removal and Multi-Session Services

Tattoo-removal and other multi-session offerings are not guarantees that pigment will be completely removed. Sessions may need to be spaced according to healing and safety requirements. The current price list states that tattoo-removal sessions may be spaced at least 4–6 weeks apart, and a patch test may be recommended.

BOTD may decline or postpone removal when the skin, prior treatment, pigment, healing status, or other condition makes treatment unsuitable. You must follow all instructions and disclose prior procedures or complications.

16. Loyalty Program, Credits, and Promotions

BOTD may offer loyalty points, credits, referral rewards, birthday benefits, discounts, complimentary items, limited-time promotions, or other incentives. Program rules, eligibility, point values, expiration dates, exclusions, and redemption limits are determined by the applicable offer.

Unless an offer expressly states otherwise:

• rewards have no cash value;
• offers may not be combined;
• rewards are not transferable;
• points or credits may expire;
• BOTD may correct an administrative or accounting error; and
• BOTD may modify or discontinue a program prospectively.

A review, referral, photo, or other activity may qualify for a reward only when it is genuine, authorized, and complies with applicable platform rules and law.

17. Academy, Model Sessions, and Booth Rental

Academy courses, training, model sessions, and booth rentals may require separate enrollment forms, payment terms, waivers, insurance, credentials, photo consent, or independent-contractor agreements.

Model sessions may require mandatory before-and-after photographs and signed consent. Booth rental is available only under the eligibility and insurance requirements stated by BOTD and does not create an employment, partnership, agency, or joint-venture relationship unless a separate written agreement states otherwise.

Course schedules, access, materials, equipment, completion requirements, and refund rules are governed by the applicable course or enrollment terms presented at purchase.

18. SMS, Email, and Marketing Communications

SMS program and messaging use cases

If you provide your mobile phone number and affirmatively opt in, Blush On The Daley (BOTD) may send SMS messages related to your requested or scheduled consultation, appointment, service, or customer-support interaction. Message types may include consultation follow-up, appointment confirmations, appointment reminders, preparation and aftercare information, rescheduling notices, availability updates, service follow-up, customer support, and—where separately permitted—promotional offers.

You must be 18 years of age or older to use this SMS service. Message frequency varies based on your inquiries, appointments, service activity, and communication preferences. Message and data rates may apply. Consent to receive SMS is not a condition of purchase. To stop receiving messages, reply STOP to any text message. Reply HELP for assistance or contact BOTD at info@blushonthedaley.com. You can also contact BOTD to update your communication preferences or opt out of marketing communications.

Appointment and customer-care messages may continue when reasonably necessary to service an existing booking, subject to applicable opt-out rules. BOTD does not sell, rent, or share SMS opt-in information with third parties for their own marketing. For more information about data practices, see the Privacy Policy.

BOTD and participating wireless carriers are not liable for delayed or undelivered messages. Email and SMS delivery may also be affected by spam filters, provider outages, incorrect contact information, device settings, or other factors outside BOTD’s control.

19. Privacy and Client Records

BOTD’s Privacy Policy explains how BOTD collects, uses, protects, retains, and discloses personal information. By using the website or services, you acknowledge that you have had an opportunity to review the Privacy Policy.

You should not submit sensitive health information through a public website form or ordinary email unless BOTD specifically instructs you to do so. BOTD may maintain service records, payment records, signed forms, communications, and photographs where consent has been provided, subject to the Privacy Policy and applicable law.

20. Photos, Testimonials, and Client Content

BOTD will use before-and-after photographs, testimonials, reviews, or other identifiable client content for marketing only when the client has provided the required consent. A service booking does not automatically grant BOTD permission to use your image or testimonial for marketing.

If you submit a review, comment, photograph, testimonial, or other content to BOTD, you represent that you have the right to submit it. You grant BOTD permission to use it for the purpose and channels authorized by you, subject to any separate written consent or release.

21. Intellectual Property

The website, logo, BOTD name, service descriptions, photographs, videos, graphics, written materials, digital guides, course materials, trademarks, trade dress, and other content are owned by or licensed to BOTD or its content providers and are protected by intellectual-property laws.

BOTD grants you a limited, revocable, non-exclusive, non-transferable right to access and use the website and purchased materials for personal, lawful purposes. You may not reproduce, distribute, modify, publish, sell, license, publicly display, or create derivative works from BOTD content without prior written permission.

22. AI Assistant and General Information

BOTD may provide an AI assistant or automated support tool to answer general questions, provide service information, assist with booking, or direct you to resources. Automated answers may be incomplete, inaccurate, delayed, or unavailable. The AI assistant is not a medical professional, does not provide diagnosis or emergency care, and does not replace a consultation with BOTD or a qualified healthcare professional.

Do not provide sensitive medical information to an AI assistant or ordinary chat channel. Confirm important pricing, appointment, eligibility, aftercare, and medical information with BOTD staff or your treating clinician.

23. Third-Party Websites and Services

The website may link to third-party booking platforms, payment providers, social-media sites, financing companies, vendors, or other websites. BOTD does not control and is not responsible for third-party content, availability, security, privacy practices, fees, financing, or terms. Your use of a third-party service is governed by that provider’s terms and policies.

24. Disclaimers

To the fullest extent permitted by law, the website and general website content are provided on an “as is” and “as available” basis. BOTD does not guarantee that the website, booking system, AI assistant, communications, or content will always be accurate, complete, current, secure, uninterrupted, or error-free.

BOTD does not guarantee a particular cosmetic, aesthetic, medical, financial, educational, or business outcome. No website statement, photograph, testimonial, or staff communication creates a guarantee or warranty beyond what is expressly stated in a written agreement.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded or limited.

25. Limitation of Liability

To the fullest extent permitted by applicable law, BOTD and its owners, officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of opportunity, or business interruption arising from or related to the website, communications, booking, payment processing, or services, except to the extent such limitation is prohibited by law.

To the fullest extent permitted by law, BOTD’s total liability arising from a particular claim will not exceed the amount you paid to BOTD for the specific service, product, membership period, or transaction giving rise to the claim. This section does not limit liability that cannot legally be limited, including liability for intentional misconduct or other non-waivable matters.

26. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless BOTD and its owners, officers, employees, contractors, agents, and service providers from claims, losses, liabilities, damages, costs, and reasonable expenses arising from your breach of these Terms, misuse of the website, violation of law, infringement of another person’s rights, or inaccurate information you provide.

27. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Before filing a formal claim, you agree to contact BOTD at info@blushonthedaley.com and provide a reasonable opportunity to review and resolve the concern. Nothing in this section prevents you from contacting a regulator, exercising a non-waivable consumer right, or seeking emergency or other relief that cannot lawfully be waived.

Any court venue, arbitration requirement, class-action waiver, or other dispute procedure should be added only after review and approval by BOTD’s attorney. No arbitration or class-action waiver is intended by this draft.

28. Changes to These Terms

BOTD may update these Terms from time to time. The updated version will be posted on the website with a revised effective date. Changes will apply prospectively unless applicable law requires otherwise. Your continued use of the website or services after an updated version is posted means you acknowledge the updated Terms.

Changes to a specific booking, membership, purchase, course, or signed agreement will be governed by the terms presented and accepted for that transaction.

29. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, unenforceable, or unlawful, that provision will be enforced to the fullest extent permitted and the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy and any applicable booking confirmation, consent form, checkout terms, membership terms, or written agreement, constitute the agreement between you and BOTD regarding the subject matter covered here and supersede prior website statements about that subject matter.
